Statement of actual return to the Dutch Tax Authority

In 2024 there has been a new ruling from Dutch Supreme Court about taxes on savings and investments (known as box 3). The Supreme Court has decided the actual return must be used to determine the tax base in box 3 if the deemed return leads to a higher personal income tax assessment. The new box 3 system will not be introduced until 2028 at the earliest. In the meantime, the Counter-Proof Scheme applies and you can use the form ‘Declaration of Actual Return’ (OWR form).

You will receive a letter from the Tax Authority
From July 2025, the Tax Authority can send you a letter. They do so if you had box 3 income in (at least one of the) years 2020 up until 2024. You could also receive a letter if you had box 3 income in the years 2017 up until 2019 and you filed for an appeal or applied for an ex officio reassessment. You will then be asked to complete the ‘Actual Return Statement’ form (OWR form). This allows you to request a refund of your personal income tax if your actual return was lower than the fixed return used by the Tax Authorities. In the form, the Tax Authority will also ask what return you have actually received. Want to know more about this? Then go to the site of the Tax Authority.

You cannot see how much income tax you will receive back in the OWR form. You will only be informed about this later by the Tax Authorities.

A lot of information you need is easy to find after logging in
• Gross dividend; is included in your annual statement
• Value 1 January and 31 December; is included in your annual statement
• Total value of purchases and sales; can be found at your transactions
• Name of investment fund(s); is included in your annual statement
• Account number; please see account overview or annual statement

You will find your annual statement after logging in. Go to My Data > My Documents > Correspondence. Here you will find your annual statement(s).

You can find your purchases and sales in Transactions > Transaction Summary. In the selection bar, you can select the desired period. You can also save your transactions using the special export button located at the bottom right of the table.
